2016 Georgia General Assembly Begins January 11

 

The 40-day session of the Georgia General Assembly begins on January 11, 2016. Education will take up a good bit of the legislative energy over the next three months. The Governor’s Commission on Education Reform has released eighty some-odd pages of recommendations to improve the return on investment state taxpayers make on K-12 students. This year is an election year, meaning not every bill that is debated is designed to pass.

Investment Tax Credit

 

Investment tax credits help Georgia businesses grow by making it more affordable to expand and improve facilities. Companies in manufacturing or telecommunications support that have operated in Georgia for at least three years are eligible to earn investment tax credits for upgrades or expansions. Credit earned amounts to 1 percent to 8 percent of qualified capital investments of $50,000 or more.

Permanent R&D Tax Credit Approved 


The R&D credit will be made permanent. This provision allows companies to claim a tax credit based on certain research and experimentation costs. Also, beginning in 2016, businesses with less than $50 million in receipts would be permitted to offset the credit against the alternative minimum tax, as well as the employer payroll tax (FICA).

Internet Tax Freedom Act: Extended to September 30, 2016


The Internet Tax Freedom Act (ITFA) was extended to September 30, 2016. This law bars federal, state and local governments from taxing Internet access and from imposing discriminatory taxes. The law also bars multiple taxes on electronic commerce.
